It may vary from state to state, but here in Louisiana, child support and visitation are two totally separate things. So yes, the father can still see the children, unless there is some other underlying issue not mentioned.
I'm not just answering this because I practice consumer collection management. I'm also answering this out of experience due to my fiancee is going through the very same ordeal. So, if you don't mind let me give you some tips on what to look out for. Don't be startled but your father should address the child support with regards to the fees that he will incur while he is doing his time. He can write a letter to the courts requesting that interest, if its accumulating interest, and fees be temporarily frozen. This will show accountability. Once he is out and faces adversity from unemployment and due to the recent recession he could calendar a court date to see the judge and request a hardship program till he's able to make adequate payments.
Good Luck!
Usually, yes unless in the (very rare) case where visitation is contingent on child support payment in the custody order. Visitation and child support are two different things and most courts are reluctant to terminate visitation rights if a father has child support arrears. You would need to contact an attorney in your state of residence or refer to your court documentation for a definitive answer.
Yes, child support and visitation are independent of one another.
Yes, he is still the father.
yes
Yes - child support debts are not discharged in bankruptcy.
what is going to happen when i give up my right as a father? will i still have to pay child support?
No, the father has to pay child support for both children. Of course the child that decides to live with him will be treated as he/she were when you were both married, but the child you have will still continue to receive child support by law!
Why not? It's still your child. Who has the child the father with mental problems or the custodial parent? Still if the father has mental problem and he fathered a child...yes he does have to pay child support. Was the father with mental problems receiving some type of disability for his mental problems? If so he is still responsible for paying child support. Does the father have custody of the child? Somebody needs to go back to court ad petition the court.
Child support arrears do not go away. If the state supported his child for a period of time then he must pay the arrears.
The support is still owed and SS benefits of any sort are subject to garnishment for child support obligations.
Back support is owed the obligee parent, however any continuing support can go to the child.
Yes, until the order is overturned, and provided the mother is not on Welfare.
what if your done with current child support but still owe interest for back support.
Only the mother has standing to learn that
