The federal government can make all sorts of laws if it so desires. There could be constitutional issues in the case of spam since that is a form of speech and may fall under the freedom of speech amendment, however, freedom of speech is not an absolute, and some forms of speech are not deemed to be legitimate, so possibly the courts would uphold an anti-spam law. If not, an anti-spam constitutional amendment would still be a possibility. Enforcement of those laws will have varying degrees of success. The federal government has not been able to control or stop heroin addiction, and I would not expect complete success if they attempted to control or stop spam, or C-span, or whatever it is you are asking about, but they may still wind up arresting some people, and stopping at least some of what they are trying to stop.
