If title insurance is not purchased at closing, then it can be purchased later. Generally a title insurance policy can be issued within 14 days of the closing.

How do you find out if you purchased title insurance when you paid cash for property purchased in VA?

Look on your closing documents. They should itemize all the fees related to the transaction.

If you get a title comittment do you also need title insurance or does title comittment mean you get title insurance also?

A title commitment is just what it is. It's a commitment. Meaning as long as all of the conditions are met on that commitment, after closing, title insurance will be issued. A commitment is not considered insurance. Your title is not insured until after closing when the new deed and/or mortgage has been recorded. At that point, the title company issues insurance. If you are buying a new home and depending on where you are, you should receive your title policy about 60 days after closing along with either the original or a copy of your deed.

Does title insurance pay for a lien that was missed at closing?

Yes that is what title insurance is for. However, there is a very good chance that the title insurance company will sue the attorney who was supposed to do the title search in the first place as they obviously didn't do their job.

How much are the costs for closing?

As a rule, closing costs to buy a new home are about 2 to 4 percent of the purchase price. Closing costs are to pay for items such as inspections, recording fees, and title insurance policies.

Where do you purchase title insurance?

When purchasing or refinancing a home, you will have settlement conducted by a Title Company, the title company is also the licensed title insurance provider. Up to two policies will be issued. Maryland Specific: If you are purchasing a property and taking out a loan, the lender will require a Lenders Title Insurance Policy. And you will have the option of purchasing an owners title insurance policy for your protection. If you are refinancing your current home then the lender will only require the lender's policy. In both instances the title insurance policies will be issued at the time of closing.

No, that will come from the title company that handles the closing.

What can be done when the title search was incorrect and did not detect an easement?

You should go back to the attorney who represented you at your closing. You paid to have the title examined as part of your closing costs. If you purchased an owner's title insurance policy the attorney will make a claim for you through her/his title insurance representative. If you did not purchase your own policy then you will need to make a claim against the attorney's malpractice insurance. The insurance companies will decide whether you suffered any damages by not knowing of the easement prior to your purchase. You may want to consult with an unbiased attorney who can review your situation and determine what your options are.
