Under federal law adebtor wages cannot be garnished by more than one judgment holder at a time. Garnishments must run consecutively not concurrently.

Child support arrearages/payments and in some states spousal maintenance payments are not considered "true garnishments" and therefore can be enforce at the same time a creditor garnishment is active. It used to be that IRS garnishments could also be active during a judgment creditor garnishment, that is no longer true. If such a situation happens the IRS garnishment takes precedence and the creditor garnishment is halted until the tax debt is satisfied.

In some instances, depending upon the laws of the state an employer can deduct monies from an employees pay without the need for a judgment writ when said employee is in some manner legally indebted to the employer.

If a person finds themselves in any of the situations noted above he or she should consult with an attorney or legal advocate agency.

If you receive Disability Income from a Long Term Disability Insurance Policy can creditors garnish the monthly income from this policy?

The answer to your question is yes. If creditors can garnish your wages if you were working, then they can garnish the income you receive from your disability provider as well. The same procedures they would have to go through to garnish your wages from your employer, they would go through the disability company (filing court documents). Unfortunately, creditors consider any income you receive, working or not, as income.

Could a credit levy and garnish your wages at the same time?

Can two creditors put a lien on your wages at the same time?

1) your wages may be "garnished" by a creditor through a legal procedure. 2) YES, if the garnishment procedure determines your wages are adequate to have multiple forced payments deducted (while you still can sustain a basic standard of living - reflected by the legal procedure), then you can have multiple garnishments (ie. by multiple creditors - a single creditor only would do the garnishment procedure once for multiple accounts you might have with them) against your wages.

How many times can same company garnish wages with no break in between?

As many times as it takes to pay off the judgment, however typically they only need to file the garnishment once unless you change jobs frequently. If not, you can always challenge the amount being garnished from your wages.

Can creditors garnish both your wages and bank account?

A creditor with a judgment can garnish your wages, your saving and checking accounts, Certificates of Deposit (if you have any), pension funds that are being paid out, unemployment benefits in many states, state income tax refunds in many states. They can also put a lien in many cases on any real property. For instance, a mechanics lien can be placed on your car, so that if it is sold the title will not be relased until the outstanding balance of the lien is satisfied. The same can be ordered for your home, any recreational property you might own, any RV's you might have. If you are a farmer, liens can be placed on any crops you might have against sale at harvest. there are a wide variety of ways to collect a debt.

Can your wages be garnished from two different employers if one is garnished for 25 percent already in Arizona?

The only time wages can be have garnishments running concurrently is if one of the garnishments is for court ordered child support or spousal maintenance. Although in certain situations judges can allow separate creditors to garnish dual incomes, but not a dual garnishment by the same creditor.

Can more than one creditor garnish your wages?

Garnishments cannot run concurrently only consecutively. The first garnishment would need to be paid before another judgment creditor would be able to garnish the debtor's income. Court ordered child support deductions are not considered true garnishments and can be active at the same time that a creditor garnishment is implemented. Also, multiple creditors can execute judgments by other means, such as liens against real property belonging to the judgment debtor.

If you owe him money, he can use the same legal means to collect that any other creditor can use to collect his debts. He can sue and get a judgment against you and possible garnish your wages, etc.

How many garnishments can be given to one person?

An individual can have multiple garnishments for debts. However, only one garnishment for debt can be active at a time. Multiple creditors cannot garnish a persons wages at the same time, the first garnishment judgment to be granted takes precedence any/all others follow in a like manner or order. Please note, garnishments for child support, spousal maintenance, tax arrearages in most cases can be active at the same time a judgment creditor garnishment is imposed.
