You can break a lease for what ever reason you decide, however you will in all likelihood still be responsible for the contract you made. That is, if you find that a registered sex offender lives in the same building, you can panic and run, but you will still be liable for the rent.

The responsible solution is to keep an eye on your kid, and take precautions against the child becoming the victim of the predator you don't know about.

Can a landlord break lease do to short sale?

Landlords give all sorts of crazy reasons for wanting to break leases. This is one of the strangest I have ever heard. A lease is a legal contract. It may contain a clause describing how the landlord can break it. The landlord may have sold the building for a whole lot of money. If he can get you out without having to pay you to break the lease then he gets to keep more money. His short sale does not involve you. He has a different motive. His short sale does not give him the right to break a lease. Your problem is your lease with him.

What information needs to be in a lease agreement?

You need to include payment agreements, what happens if he refuses to pay, how much time he has to get out, things he is responsible for in the building, things you are responsible for (damages or things that break), the condition the building needs to be in when he leaves, how long the lease is for.

What are my rights should the landord wish to break lease?

As a tenant, if the landlord wishes to break their own lease, you have the right to seek damages just as they would if you had broken your lease. The usual outcome for a landlord to break a lease is that the landlord forfeits any right to retain the security deposit.

Can you break a lease because you have found out a sexual predator lives in your neighborhood?

No, a landlord has no control over who moves into a neighborhood. Where the sexual predator can live depends on terms set by the court. What one can do is find out if the person has registered with the local police department, as is required by law. If the person is breaking the terms of their release and/or probation, they can be reported and perhaps be forced to move or even be incarcerated. Most sexual predators cannot live within a specified distance of schools, playgrounds, places where children are prevalent. These laws will differ by state, and the best choice is to consult the local police for advice. DON'T BE FOOLED. Reread your lease. My lease says that under the "Legal Use" section a "resident shal not violate any criminal or civil law" or "annoy or molest" a resident or neighbor. If you see this person "annoying" or "molesting" you (this could even be brushing up against you sexually in a room) or your children write a letter describing what happened asking the landlord to terminate the lease of the sex offender. If he doesn't do that, you have proof (the letter) that the landlord has made the place "inhabitable" and therefore you must break your lease since they have broken their agreement. Is a landlord required to make sure you have running water and yet allow you to live next to a dangerous criminal? What is safety? GIVE ME A BREAK! CA
