If you live in the US... I'm sure you could 'bring it up'. The question is would it accomplish anything? Most states don't consider martial fault as factors in things such as property division, alimony, child custody (unless the affair had a DIRECT affect on the children), etc.
* If you have proof of an affair then yes you can use this in court to get a divorce. It's called 'infidelity.'
His affair with Abigial because he knew she would bring it up in court anyways.
He tells danforth that he had an affair with Abigail because he knew Abigail would bring it up anyways in court
You have the right to tell your attorney so that he/she can bring this up in court. You may be eligible for a share in the assets.
Yes, if the judge signs the divorce papers and one party does not show up in court, the divorce can still go through. This is known as a default divorce, where the court proceeds with the divorce based on the filing party's claims and evidence.
Does the plantiff in a divorce have 2 show up for court
Yes. You can work it out together, go to counseling. Don't give up hope, don't get a divorce. Figure this out together. There is life after an affair.
The great part about an uncontested divorce (both parties agree) is that you can proceed with a divorce without a lawyer. You are able to represent yourself in court and save time and not to mention money. Your spouse won't need to show in court when using this company. If you file for the divorce, you will be the one finalizing it. Your spouse is served, he/she signs and you attend court to finalize the divorce.
If you can, try to make up with your spouse. If that doesn't work, divorce is probably the best thing for you.
any court case that is dismissed without prejudice means it can be heard again at a later time. if it is dismissed WITH prejudice, it means don't bring it up again.
You can, but it is likely that you will be arrested when you appear.
nope
Not in the US, but they can stipulate in advance the terms of any divorce. The court may or may not honor those terms.
