The act of voluntarily relinquishing parental rights is never a sure thing except in cases where it pertains to allowing a child or children to be adopted. Although it is not necessary for both parents to be in agreement of TPR action, either parent has the legal right to contest the petition especially when it is made for the expressed purpose of the petitioning parent to avoid financial obligations. FYI, judges only grant TPR decrees when there is incontrovertible evidence that the action would be in the child's best interest.
