A criminal charge would not be applicable. However, if the debtor has proof that a collector has made threatening remarks such as noted they have violated the FDCPA and are subject to censure.

Can you be arrested in Maryland for not paying your payday loan?

No. Payday lending is illegal in Maryland. Contact the Commissioner of Financial Regulation in Maryland. File a complaint. They cannot claim that they can have you arrested. This is also a violation of Federal law, check out the Fair Debt Collections Practices Act (FDCPA). Keep records of your conversations with these collectors, and who you talk to. You could also contact a consumer rights attorney and sue the collector for violation of the FDCPA as well.

What happens if you cant pay your online payday loans if you live in Maryland?

In Maryland, legally you have nothing to be concerned about. Payday lending is illegal in Maryland. No payday lender could successfully take any legal action against you. They will still harass you and attempt to scare you into paying them. They will threaten to sue, arrest, garnish, suspend your license, etc. They can do none of these things. You need to report any payday collectors to the Maryland Commissioner of Financial Regulation. They will advise you of the laws, and initiate an investigation into the payday lender/collector.

Can payday loan company sue?

Yes, however, the company is not likely to do so. Payday loans are generally less than $2,000 so most payday lenders will not go to the trouble to sue someone. However, what they may do is sell the bad debt to a collector and that collector may be willing to come after the debtor as collectors are set up for recovery via the legal system.

What are the wage garnishment laws for payday loans in MD?

Your wages cannot be garnished for a payday loan in Maryland. Maryland has outlawed payday loans. They are unenforceable. The lenders will threaten you with garnishment, but they are powerless. They are simply trying to scare you into paying them. A legitimate collector would have to sue you in court for a judgement to get a garnishment. No collector can garnish your wages without a court order. You would know you had a court date because you would receive a summons to appear in court for your defense. Contact the Maryland Commissioner of Financial Regulation and they will initiate an investigation into the payday lender/collector that is hassling you.
