Yes. It would be civil. To file criminal charges a report is given to police. The police submit a referral to the District Attorney's office. The Charging prosecutor would decide to file criminal charges or not. To file a complaint on your own, get paperwork for a petition. Fill it out, then go to court and file it. There usually is a filing fee. You can obtain paperwork there or at a library or purchase them at an office supply store. The courts have instruction packets with their paperwork. The court does their thing then sets a hearing date. You would contact the defendant through mail or have law enforcement serve paperwork. If you win, collecting damages (money) is another story.
