You cannot force your ex to sign divorce paperwork or anything else. If the person refuses to sign, the courts are able to proceed without it. Check with your lawyer to find out what the procedure is in your state.

what happens if I do not have an address to notify my partner of my intent to divorce?

You'll need to file a 'Petition for Divorce, Summons with or without Children, Spouse's Location Unknown.' What happens is that the notice of the divorce petition will appear in a local publication acceptable to the court. That will be sufficient notice for the courts to proceed.

How do you serve divorce papers to someone in Jamaica?

You should visit the family court in your jurisdiction and request a packet of the documents that must be filed along with instructions and a time schedule. Many courts allow the parties to proceed without an attorney if the parties can agree and there are no complicated issues. If possible you should arrange a consultation with an attorney who specializes in divorce. The divorce lawyer will explain your legal rights and available legal options to handle your divorce case in an effort to obtain positive results. During divorce, you may need to take various emotional or sensitive decisions regarding your children and your future. For that, you can get help from your divorce lawyer and further you can proceed your divorce case with child custody and support, spousal support and property division and settlement.

My Ex is on probation for felony injury to a child. The courts took his rights away from him giving me sole custody of our children. So what do I need in order to file for divorce from him?

You need to hire a Divorce Attorney and file the paperwork. Your reason for filing divorce is rather straightforward at this point as the court has already ruled against your husband regarding your children.

Your husband filed for divorce can decline it?

Unfortunately, no. If one party to a marriage wants to get a divorce, then it will be granted with or without the consent of the other party. Courts simply will not enforce a situation where it is no longer working for some. You have the right to contest the divorce but declining the divorce will not stop the procedure from happening.

I want a divorce but I don't know where my husband is and all I have is his last known address what do I do?

I think you should visit his last address and try to arrange a divorce with his consent of course. Just wait. He has to show up eventually. If he doesn't, it means he has lost interest and you should move on.

What happens if spouse refuses to sign divorce paper in the state of AR?

Although that can make an already difficult process more difficult, you can still get a divorce. Courts simply are not going to keep you in a "contract" that you want to get out of. You need to show the court that you used due dilligence to serve the other party and that their refusal to sign the papers is no fault of your own. After the court is satisfied with this showing, you can proceed with the divorce as if they had signed the divorce and a default divorce will be entered and you will in fact be divorced.

Should I contest a divorce in a no fault state?

Generally not a good idea to let the court hear only one side of the case. This is especially true in California since the courts believe whatever is in the paperwork of the filing party and most uncontested cases are done on the paperwork. Best to have a settlement agreement signed and filed so you know what the outcome is rather than hoping everything will be okay. By the way, I'm a divorce attorney in California.

Do federal courts have jurisdiction over divorce cases?
