No. And if someone wants to give you one, run away from that dealer.
If there was a secured loan and you reaffirmed the debt in your chapter 7 and you have paid off the loan, you should get the title from the lender. If you surrendered the car to the lender in your chapter 7, your balance was discharged as an unsecured loan and you have not owned the car since you surrendered it.
yes, I did.
Generally - Chapter 7 allows you to purchase a car or get a loan for a car after DISCHARGE (about 6 months after you goto court - you'll get a letter) Chapter 13 allows you to purchase a car at anytime WITH permission from the Trustee. Its called a Motion to Incur Aditional Debt. I went to court in August 2004. My debts were discharged October 2004. I just bought a car in December 2004. I got a good price and a high interest rate, but it was still a lower rate than I was paying on the car I included in the bankruptcy! I still can't believe how easy it was. If you're in the Puget Sound area, I can tell you where to find a car loan. What kind of downpayment did you have to do?
The loan must be paid before you can transfer title to the car.The loan must be paid before you can transfer title to the car.The loan must be paid before you can transfer title to the car.The loan must be paid before you can transfer title to the car.
It all depends on your score.....12 months after discharge, i bought a brand new car....$32000.00 at 9% interest rate.... DO NOT fall into the 18% trap, you are better off buying a junker until you get your score to about a 620-650.
You should be able to do so, yes.
I'm not clear what you mean by "both of your incomes". But it seems your saying your wife was he only one who C-7, which means received discharge of debt. Hence, if you were on the loan, it would seem you are still responsible for the loan.
If the Chapter 13 was dismissed before the Plan was completed and the balances of unsecured debts discharged, you may have a difficult time getting a car loan. If the Plan was completed and you have a discharge, you will be able to get a car loan at car dealers, but you will pay a high interest rate. If you make on-time payments for 6 months, you may be able to get a refi on the loan at a lower interest rate. Your best bet is to open an account at a local credit union and apply there for a car loan.
Whether your car loan is discharged by a bankruptcy or not will depend on your state and the equity in your car. Whether the loan will be discharged or not is called an "exemption".
If you filed a Chapter 7 bankruptcy and buy a car before the discharge is issued, there's no impact on your case. If you're in Chapter 13, however, your disposable income post-filing until discharge may be considered property of the estate; in addition, if you're financing the new car then you likely need to have the court's permission before entering into the financing agreement.
Bankruptcy is a federal action in a federal court, whether in New York State or elsewhere. You cannot get a loan while in a Chapter 7. No creditor will lend to you until you have received your discharge.

Chapter 7 stays on your credit report for 10 years. You maybe able to get a car loan but the interest rate will be high. So, you have a choice pay the high interest or not get a car.
Yes you can if you have a fair credit score.
yes, I did.
Highly doubtful.
If the lender is willing to reaffirm the loan with the borrower then the vehicle can be returned. A vehicle is a secured debt and is not subject to chapter 7 bankruptcy laws.
