To get a no fault divorce in NC. you will need first to have been separated for 1 years and 1 day; and the plaintiff must have been a resident of NC for at least six months. If you meet both requirements, than you can file for divorce. Once you have filed before the court, you will need to wait 30 days for the other spouse to file an answer (if the spouse has been served) or 40 days if the notice was given by publication. If no answer has been filed (or the answer has been waived) you can request a divorce hearing and the timing will depend on the overload of the court. If, on the other hand the other spouse files an answer, than you will need to wait for an additional 30 days, making now 60 days from the original filing, prior to be able to have a divorce hearing.

Where you can and cannot file for divorce can certainly be confusing! You can file for divorce in the state you got married in and any state that you or your exspouse is a resident of. If you are not yet a resident of a state then you have to file in a state in which you are. Generally, states require spouses to be residents for either 6 months or a year before filing for divorce. For example, Vermont, Texas and Pennsylvania require 6 months or 180 days of residency. New York, Iowa and Connecticut require 1 year. A few states have shorter required periods - only 60 days of residency are required to file a divorce in Arkansas, Kansas and Wyoming.
