You can get bail only if you have been arrested and arraigned or the judge who issued the arrest warrant set bail when the warrant was issued (however, arrest is still a prerequisite for making bail).

"Non-bailable Warrant" means that a person arrested shall not be automatically entitled to be released on bail, unlike the Bailable Warrant, where the arrested person has an inherent right to be released on a suitable bond, upon the arrest. It however needs to be known the court may or may not order the person arrested under a Non Bailable Warrant, to be released on a suitable bail - with or without any conditions.

If out on bail and arrested for something else does the bail money return to the person who posted it?

I am in the same situation. My fiance was arrested, but I had posted bail. Then probation violated him, so now he is incarcerated yet my bail has not been released for the previous arrest. The time he has served does not account towards anything because technically he is out on bail. How do I go about getting this bail revoked so the clock can start ticking ?

Can people bail others out from being put to death?

No. Bail does not allow a person to be free from jail or a death sentence. A person arrested is still considered innocent until a guilty verdict is issued. However, he is kept in jail to insure he does not run away. Under some conditions, a prisoner is released if there is a way to insure he will show up for the trial. One way is with bail. A person is released after giving the court a substantial some of money to hold until he returns for trial. At that time, the bail money is returned. If he does not appear for trial, he forfeits the bail money and an arrest warrant is issued for his recapture

Why was the Wikileaks president in jail?

Julian Assange was arrested and placed in jail temporarily while awaiting trial. He was arrested due to an arrest warrant issued by Sweden for the crime of rape. And was jailed because the judge did not grant him bail.

What is an American bail bond?

An American bail bond is the act of paying a jail a certain amount of money to release someone who has been arrested. The condition is that if any court dates are needed the bail bondsman will find the person who was arrested if they skip court. There is also a bail bonds company from Longview, Texas called American Bail Bonds (although this question specifically asks about American bail bond and not American Bail Bonds).

What is the process to get someone that has been arrested out on bail?

Contact the arresting agency to find out the exact amount of bail (Police department's generally don't make change so bring the exact amount). Respond to the department. You will fill out paperwork showing ownership of the bail money, and that the owner of such money will forfeit it if the arrested subject does not show up for court. Once the bail is accepted the subject will be released pending a court hearing.
