Do you mean, can you collect child support from another man, even though your husband assumed legal parentage by signing the child's birth certificate? Generally, no, not easily anyway. This issue, and the related laws, is complex with no clear uniformity in the United States. In most states, Equitable Paternity is the rule of law, meaning any child born of the marriage is the child of the husband by default.
Depending on the laws in the state where you reside, you may have to get your husband's name removed from the birth certificate, revoking the legitimacy of the child, then get the bio father into court via a summons for a court ordered paternity test, then if/when parentage is established, go after the bio father for child support. In doing so, you will (or should anyway) also hammer out a custody agreement allowing the bio dad visitation and decision making rights in your child's life. It's also highly unlikely the courts would order retroactive child support for the period of time your husband was providing financial support for the child.
You really need the advice from an attorney specializing in family law in your state of residence to discuss your options and how it can be done, and even if it can be done.
Unlikely. Your husband is the legal father of the child.
Your husband will have to somehow prove that he is an American citizen. So, yes, he will need a certificate, as would anyone petitioning for his or her spouse, American-born or naturalized.
Though not strictly illegal at this point of time, it is Paternity Fraud and the laws will be changed.
Legally no. The only way you would have to pay support is if she removed the other mans name from the birth certificate and got a paternity test. The people on the birth certificate are the legal parents unless otherwise removed which costs $500 to do. Good luck.
Stepparents are not responsible for their stepchildren. You are not responsible for your husband's child(ren). However, to collect unpaid support, the State may place liens on real and personal property, including bank accounts, even though you are a joint owner.
You can buy a certificate but it's illegal though and if you are caught you will be prosecuted.
You would need to work with the Philippines child support agency to accomplish this.
It depends on which state you are in but most states will not place a lien on any property for back child support. Some states will report back child support to the payer's credit report though.
I have an old Matador painting signed RiKi,no idea who it is though.
No. You can get it signed by Derek though.
Yes but have your marriage certificate handy
To clarify, if you mean a woman has had an affair and become pregnant? If this is the case, and the husband is aware of it, he can order a paternity test to determine if the child is his or not. If it is not, as far as I know, the woman can go after the man who fathered the child for financial support. Support obligations only belong to the actual biological father OR a father who has legally adopted a child. There is a whole moral issue though - if the parents are staying together, does the husband want to alienate this child by not supporting it and how would he live in the same house and not support it? So really it depends on if the couple stays together. If they don't, the husband has NO obligation to support the child.
