Yes you can go to jail for complicity to theft, it's a misdemeanor 1 and you can serve up to 180 days and three year probation and a huge fine. Unless you can prove otherwise that either he or she didn't know that the other person was going to steal. You will need a lawyer don't go in it with out one or the judge will hammer you, even if it's your first time. Oh yeah, and may be required to take a theft class as well.
