NO...The cheque although sent to you by mistake is not "rightfully" -Yours.Have you found out who sent it? and why? Have you tried contacting the sender?

You must surely know whether you were expecting some payment or not?....IF NOT..THEN CASHING THE CHEQUE IS DECEPTION !

Although the law varies in different countries, like -"finders-keepers"-nevertheless the moral issue as the one mentioned above is the one most appropriately used.

You may be advised to see a local lawyer in your country for further advise..however!!

Can you be sent to collections if you make a payment every month?

You should not be sent to collections if you are making monthly payments. Some companies have their own "polocies" on how much your payment needs to be in order to keep from collections but the law says that you can pay what ever you want as long as you don't sign a payment contract.

If you sent a payment to the bank clearly noted for a car loan but they deposited it in your account instead and then your car was repossessed can you sue the bank?

It depends. What was the result of that error being made? Was your vehicle repossessed because the payment went to the wrong account? As far as "legally filing a lawsuit" you can do that to anyone for anything. Most banks will rectify the mistake by correcting the routing of that deposit and clearing the late fee if they see that the payment was received on or before the due date. However, they can tell if it was an honest error or if you are trying to slip one by on them.

How will I know if the money has already receive by the receiver?

Never send cash, if sending a payment through the mail, send either a Money Order, Cashiers Check or a Personal/Company Check. Your best options are to have the letter sent registered mail and request a received receipt that the receiver must sign in order to receive the letter and payment. If you have a business, it is better to send a business check and send it registered. You can have a receipt for when the person receives the letter and once the check is cashed, your bank can show a canceled check. if payment is being made in person, GET A SIGNED RECEIPT. Do not allow them to SEND you a receipt in the mail, get it immediately with a signature showing that payment has been made and received. If you sent cash, then you have no way of knowing and must trust the honesty of the receiver. However, if you sent a money order, cashiers check, or personal check, those can be traced and signatures can be viewed to see if they were cashed and by whom.

You recently quit your job for a new one your old company sent you your regular check for time you didnt work Can you legally cash it even if they made a mistake?

You can cash ANY check lawfully made out to you. HOWEVER - if the check was made out for too much, and you know it, you could be charged with larceny or fraud if you kept it. On the other hand, if the check was for too little, the company could claim that, by the act of cashing the check you "accepted" that amount in full payment. It's up to you -- make your own choice.
