They can do so if they are not breaking a lock or damaging property in the process. They may not enter a private residence. They must cease if told to do so, otherwise the repossession becomes non-peaceful and may be illegal. If in doubt, call the police, do NOT start an altercation or you may be held responsible.

It is against state law to open a locked gate.

Can the state of North Carolina charge for personal property when they repossess your car?

The state doesn't repossess your car - private companies do that on behalf of the lienholder. They don't charge you for private property left in your car when they repossess it - that would be illegal. They charge a "storage fee" for the items they remove from your car. Underhanded, yes, but they can legally do it.

Do you have the right to go on the property to repossess a car in the state of Georgia?

Yes, as long as it does not constitute a breach of peace, such as attempting to remove a vehicle from a locked or unlocked garage. Unless the property is legally posted.

Your car was reposessed out of your garage at home it that legal?

Yes, if it was not locked. They cannot breach the peace to repossess a vehicle but they can come on your property to get their property, namely the car you do not own. It is their car until you pay for it. So legally they have only recovered their property.

What is a reo property?

REO (Real Estate Owned) is a class of property owned by a lender, typically a bank, after an unsuccessful sale at a foreclosure auction. A bank will typically set the opening bid at a foreclosure auction for at least the outstanding loan amount. If there are no bidders that are interested, then the bank will legally repossess the property. This is usually the case as the amount owed on the home is probably higher than the value of this foreclosure property. As soon as the bank repossess the property, it is listed on their books as REO, and is categorized as an asset (non-performing).

How do you legally repossess a car from someone late on their payments that's in lien to you but registered to them?

From my Experience All you really need is a written Contract on the said property, Dealers, Used car lots, and Banks register the property financed so it shows the lien on the title. Private sales with money owed if you have a written contract you can repossess on site. if this is an oral agreement, You will have to go through the small claims division of the county courts
