If the pilot has a license to spend money in Cuba, the plane can legally be refueled in Cuba. Unfortunately, if you're not a journalist, academic researcher or Cuban-American who has family in Cuba, you can't get this license.
No you can not go to Cuba legally. But some airlines do let you go, but it is illegall. That is what I found but doubled check in another website just in case.:)
