Herpes could be passed onto a baby in a few ways.

If the mother has a break out of herpes as she goes into labor she could pass herpes onto the baby.

If some one with a visible cold sore (caused by oral herpes and contagious) then kisses the baby then the baby could get oral herpes.

It's not going to be passed to the baby just by touching it.
