Generally you will be disqualified for the amount of time that you receive severance. For example, if your weekly benefits are $400 a week and you earned $1200 severance, then you will be disqualified for a month.
It depends on the particular state. Most allow both, but offset the unemployment benefits the week(s) in which the income was received for the severance pay. You still have to qualify as any other claimant for unemployment.
Yes, unemployment is only related to how and why you separated from your employer. Anything that took place afterwards or compensation from your employer would not be relevant.
It is illegal to collect unemployment benefits while employed in NYS.

if on nys unemployment, if sick, should you say no work that week and say workman's comp?
Yes and No. Depends on certain factors. But, yes you can file a claim. Call NYS AWFI.
If the question is . . how much unemployment money do you have to steal before going to jail . . . then the answer is ANYamount is an unlawful/illegal amount. Unemployment compensation comes from the taxes paid by everone else. When you commit fraud to receive unenmployment (or ANY other form of welfare) you are committing theft against ALL taxpayers (i.e.: "The State").
To my understanding, if you were fired, you can only receive unemployment if you were not at fault. I was fired today & just filed a claim online. I will receive my 1st check next Wednesday. Just prepare a good excuse as a backup, just in case you're ever taken to a trial.
Of course you can collect.
It really all depends on your union contract language. In southern CA, in my specific school district, we can get receive unemployment benefits even if you resigned. Contact your personnell office or the union president. They should have an answer! It really all depends on your union's contract language. No. Couldn't even certify. My best guess is we'll be able to certify at midnight.
You can check, of course, but it is likely that your employer paid their unemployment compensation payments into the NY state unemployment pool and NOT the NJ pool.
Hi~ Workman's Comp benefits are non-taxable.
Today 11/21/2008 it was on channel 4 NBC news that President Bush has signed the extension for unemployment extended benefits. Meaning that there will be 7 additional weeks and 13 additional weeks for the state that has over 7 percent increase in unemployment.
