Its at the discretion of the complex... but, I just tried to twice and got denied. My charge was almost immidiately dismissed, but they dont really care. So dont give them that non refundable app fee untill you know.. just lost $200 learning the hard way
Is it a pending charge for a felony or a felony conviction? If so, then no. Not in Texas, nor in any other state.
no there isnt and im a fbi agent
The charge is assault. The punishment is: (1) a fine not to exceed $4,000; (2) confinement in jail for a term not to exceed one year; or (3) both such fine and confinement.

Telling you the truth having a gun charge in Texas is really big. If you have the evidence pointed to you your pretty much screwed the only way it could get dismissed if their ain't no evidence. Sorry so harsh im studing law right now and i seen alot of cases like this. If you shot the gun or did anything with a drive by shooting your looking at 5 to 99 years in the penitentry.
No such thing.
If a victim makes a report to the police and the police have either evidence, or a 'reasonable cause to believe,' that the assault took place, they may make an arrest.
Yes, as long as the case was not dismissed subsequent to serving community supervision (probation). See the Texas Code of Criminal Procedure Article 55.02 for the procedure.

"Anyone can sue anybody for anything." If there was sufficient probable cause for your arrest to begin with, simply because the charge was 'dismissed' would not be sufficient grounds for a suit, unless there was MUCH more to the incident than the question reveals.
If no weapon was involved and it was NOT a sex assault, the SOL is 2 years.
