Legally you can, however there is nothing protecting you from having your product idea stolen so its probably not a good idea

latent means a hidden something : patent means a document that says that you have the right to make or sell a new product.
Patents protect inventors from having their work copied by others. The work to be protected must be original, useful, and not obvious. An example of this is the popular drug Zocor. It was under patent until June, 2006, so no other company could make and sell that drug. The patent expired and now other companies can sell the drug labeled with its generic name, Simvastatin. Once issued, a patent can be used to prevent others from making, using, selling or importing any product or service that infringes any valid claim in the issued patent, but only in countries where the patent is issued and valid.

Supposedly it expired decades ago...
Lipitor which expired in 2011 was the most valuable patent ever with sales exceeding $105 over the life of the patent.
Absolutely! You can sell your product at any time, whether you have a patent or not. However, you need to make absolutely certain that your product is not in violation of someone else's patent, or your could be sued . That would not be wise. A pending patent means approval is most likely coming but sometimes the search comes back saying there is a similar product on the market and the patent is denied after all. It's best to wait until you get the absolute go ahead before you start making any plans for sale.
The purpose of a patent is to give you ownership of the product you invent. If you want to make money or sell the product you invent, you must have it patented as almost all potential buyers will not but the product if it is not patented.
sorry, I meant diovan
No, for several possible reasons.A product is not patented - an invention is patented.Only a "new and non-obvious" invention can be patented.A patent expires, usually in 20 years from its initial filing date.Once a patent has been published or a product used in public, the invention is no longer considered "new" in most countries and can never be patented by anyone else.If a patent was not filed within one year of public use or sale (in the USA), the rights to any patent on the invention are forever waived. After a patent expires, the invention becomes public domain. There is no way to "renew" any expired patent.Only the original inventor of an invention can file for a patent.
