I wouldn't use that for a divorce reason etc...but I would seperately sue my husband in a heartbeat... Extremely cruel and warped behaviors..that have had horrible results....and caused extreme emotional damages... These pukes have got to own up to this sick warped crap...and sueing is darn good idea....in My Opinion!
You will find it very difficult to sue for mental anguish caused by voluntarily reading your husbands letter.
Mental Cruelty is extremely difficult to prove. If you have witnesses; tape recordings or camcorder evidence this could help in your case. It is most important the victim seek out a lawyer that deals with physical and verbal abuse to see if the victim has a good case at all. If the victim should win then yes, damages may be deemed in some cases.
Now a days you can sue anyone for anything. But you should get a great lawyer. And its probably going to be a hard case... and you don't really have a chance of winning unless you have proof of the mental abuse, the proof would be what your therapist or psychologist says.
yes that is mental cruelty because he has no reason to file for a divorce with no proof what so ever
NO
Yes you can sue anyone for abuse
Whether or not you can sue your husband for an STD depends greatly on where you live. If you get an STD from your spouse, you can sue for negligence, emotional distress, battery, and breach of contract.
The type of law suit you are referring to is called Alienation of Affection. It is only still allowed in a few states, and California is not one of them. Mental distress is not a cause of action.
As of my last update, Lin Sue Cooney's first husband is Patrick Mcmahon. They were married for several years before divorcing.
