Kind of late for that - You would have to had documented everything that happened nearly 40 years ago and have eyewitness accounts (signed) as to what may have happened. The delivering MD may no longer be living, much less any of the hospital staff from that many years ago.
In short, the "Statute of Limitations" has run out a very long time ago.
