Yes, as long as you don't go on the interstate, and use common sense. A 49cc is considered a "moped" or "motorized bicycle". They are only "designed" to go about 30 mph, so try to stay on roads 45 mph or under, or you will be a hazard. I have a 49cc and it's perfect for commuting and local trips - no place over 45 mph. And wear a helmet - not only will it protect you, but it gives you and the drivers around you confidence that you know what you are doing (I know that sounds crazy, but it's true). This will depend on what the use of the sidewalk is. It would not work in a busy urban area, but as a path in the garden it would work well.

Whether or not you need to use sand as a base in laying a sidewalk depends upon what you are laying it with. For example, if you were using bricks, it would be better to use a sand base to prevent the bricks from shifting over time.
