No you cannot use someone elses image without permission, regardless of whether the copyright date has been "updated". Since the law was amended in 1989, it has not even been necessary to include a copyright notice in order for a work to be protected.

The only exceptions would be; if it would qualify as "fair use", or if the material has fallen into the public domain.

It is up to the owner of the copyright to keep it updated, so yes, if it is expired you can use the image.
