His gate really jars my fence when he shuts it. I think he should put his own post in and attach his own gate to his own post.
You need to talk to a real estate attorney in your area. If the neighbor does put up a gate, you need to have a written agreement which will detail who will maintain the gate, who will have access, etc. Specifically, you need to be sure that the gate is compliant with all applicable codes and ordinances, as any code non-compliance could jeopardize the fire department's ability to get to your home in case of an emergency. And a fence across the road could create a possible adverse possession claim, which, however frivolous, would be expensive to defend in court.

Technically, if your fence is on your property, then no, but if you want to keep the peace in your neighborhood then really think about whether the gate is disrupting your life or just a minor annoyance that you can overlook.
Yes the gate can be installed without removing the fence. But if the company that installed the fence forgot to add the gate I highly doubt I would want them to come back and do the work.
A gate opens and closes, like a door. A fence partitions off pasture, crops, etc. and is not meant to be moved.
