It all depends on your state law. Most states do not allow any flashing lights that are the same on emergency vehicles. So you have have to look under your state laws regarding vehicles.

The use of red (not orange) marker/tail lights on the rear of vehicles was standardised in 1949. It was not an American or a Japanese idea, it was European, in Vienna "the 1949 Vienna Convention on Road Traffic" Prior to that it would seem that rear lights were just regarded as a good way to avoid getting involved in a "rear end shunt".
