Who delegates law and how is it done?
Delegation is a power to make further addition or alteration by making a separate set of rules/regulations, in addition to the already existing legislation. This power is bestowed by the parent legislation and can be used only when such provision of delegation is apparent. A delegated legislation is always subservient to the mother legislation and there can be no deviation from the main fabric of the mother legislation. "Rules" framed under an Act is an example of delegation. An authority who has been expressly given the power under the parent legislation to delegate can only delegate a law. Procedure for making a delegated legislation is very crucial and unless such procedure is strictly adhered to, such delegation can be declared void by any competent court of law, on the ground of being hit by the concept of PROCEDURAL ULTRA VIRES. The process of delegated legislation (ie delegation of law) is done chiefly by adopting two methods, namely, PUBLICATION and LAYING THE SAME BEFORE THE PARLIAMENT. To cut a long matter short, it can be safely stated that (i) delegation of law can only be done by the person who has been authorised by the parent statute; and (ii) if the parent legislation is passed by the Parliament (Legislatures), then the delegation is done by the sub ordinate limbs of the Government (mainly the Executives).
