Yes, but only if the justice meets retirement guidelines for the federal judiciary, originally established in the Judiciary Act of 1869 and slightly modified since. Generally, a US Supreme Court justice may retire with full pay and benefits if the justice has served at least ten years in the federal court system and his or her years of service added to the justice's age equals 80 or more. For example, a justice with 10 years of service may retire from the bench at age 70; a justice with 15 years of service may retire at age 65.

Justices who retire or resign without meeting the above requirements may receive fewer or no benefits, depending on circumstances.
