Only if they want to win. If plaintiff fails to show the case will be dismissed. If defendant fails to show the court will let plaintiff proceed to prove his case. In that situation, there is no contempt of court or any other such charge that would be made against the missing party.

Civil trial vs criminal trial?

In a Criminal Trial, you have a Prosecutor and Defendant. The prosecutor's job is to prove beyond a reasonable doubt. In a Civil Trial, you have a Plaintiff and a Defendant. The plaintiff's jog is to present the preponderance of the evidence. Both can be jury trials. The bar is lower for the defendant in the Criminal trial. He can demand a jury trial and get it in most situations. Beyond a reasonable doubt means almost certain. Preponderance of evidence means the evidence on the side of the plaintiff is a whole lot stronger than that on the side of the defendant. Still, what a jury will decide and award one party is frequently simply a guess. It can differ quit a bit from theory.

What is case managment?

A CMC is a meeting that takes place at the Court House. Attendance at this meeting is limited to the Judge, and the parties (the Plaintiff and the Defendant). If party has a lawyer representing him or her, the lawyer may also attend. This meeting happens after the Plaintiff begins the lawsuit by filing the Claim/Summons, but before the trial. Generally, the CMC is 30 minutes to one-hour long. This meeting is not a trial and, therefore, witnesses do not attend at this stage. www.sasklawcourts.ca/docs/Small_Claims_CMC.doc

What are the pleadings filed by the plaintiff?

The defendant files an Answer to the Complaint. In the Answer, defendant responds to each allegation of the complaint, one by one, stating whether the defendant admits, denies or leaves plaintiff to his proofs as to each individual allegation. Also, a defendant might file a counter-claim, if defendant has an affirmative claim against plaintiff. A defendant might also file a cross-claim if defendant believes that some other person is responsible for plaintiff's damages.

How do you drop cases before trial?

It depends on the type of case. If you are a defendant in a criminal action, you can plead guilty. In a civil matter, you may be able to dismiss if you are the plaintiff, but only if there is no counterclaim against you. You'd need to talk to a lawyer in your area for specifics on your case.

What is the name of both sides in a criminal case?

That will depend on whether the case is a civil or criminal trial. In a civil court case the two sides are the defendant and the plaintiff. For a criminal court it will be the defendant (the accused) and the government entity bringing the charges, usually the State or Country.
