It could be that they need rehabilitation more than punishment, although some criminals may view that as a punishment in itself and may not respond to it.Answer 2It also depends on the crime they are arrested for. Certainly, a serial killer could be considered a wicked person deserving of punishment, but someone who gets a traffic ticket is not likely to be a wicked person. However, they are both criminals. They also both deserve punishment for their crimes in accordance with the weight of their offenses.
