If the phone was provided by the company, then yes; a phone provided by the company, and paid for by the company, is the company's phone, and must be surrendered to the company when you leave unless other arrangements are made. If you do not return the company property to the company, the company can swear out a complaint for theft, and if the phone is valuable, you can get arrested for it.
