However - if it has actual pedals on it and it is 50cc or less - it is considered a moped and you do not need a license. I know I drove one for years here in FL without a valid license (suspended for speeding WAY over the limit - youth and stupidity sometimes go hand in hand.

you can be arrested for this. that would be the same as driving a car on the side walk. i saw a kid driving a scooter one block on a side walk in miami and watched him get arrested for reckless driving on a sidewalk. a 49CC scooter has to be driven on the road with a license plate like a car.
