In order to search your home, the Government should have any of these: 1. A valid Search Warrant. 2. Probable Cause to assume a serious crime is being committed at that very moment (loud stereo would not qualify; gunfire would). 3. Probable Cause that someone needs rescue at that very moment. 4. Must be in pursuit and have cause to believe the fugitive ran into the house 5. Your permission. Various new access clauses that have not been interpreted or tested appear in the PATRIOT act, that may or may not allow searchs in the interest of national security. If law enforcement personnel legally enter your property, they are bound to search only for whatever is listed in the search warrant, but may also seize illegal or evidentiary items in plain sight. An officer with a search warrant for a piano may not legally search drawers in your cabinet, but may seize the pot plant growing on the dining room table.

Yes, I totally believe that this is a fair law, as long as the government has reasonable suspicion that your home harbors a dangerous substance or unlicensed weapon.
