I don't think there is. There is a lot more to a job than it just being open. I believe you have the right to check out the company and make a decision if it is a match for you. As I was being layed off at my last job, I was offered a lower position which I did not want. I declined and still had no problem with unemployment. What the company can do, and did once, was TELL me I was being transferred to the lower position, and then I have no say.
