When a gift is given, its your to do with as you please. Give it back or keep it, its up to you. If it was an engagement ring and the marriage didn't take place-I believe you have to give it back. Now if you paid for your own ring and can prove it, then keep it.

Should you get back your engagement ring if the engagement is called off in the state of Illinois?

Typically, an engagement ring is considered a gift. However, if the recipient of the ring breaks off the engagement the ring is usually returned. If the giver of the ring breaks off the engagement the ring is usually not returned and considered a form of apology.

Should you get back your engagement ring if the engagement is called off in the state of Florida?

Why would the state matter? You gave the ring to her as a gift. No, you shouldn't expect it back.http://site1.wikianswers.com/images/blank.gif?v=33248 Actually, you should abosolutely expect it back. The ring is not a gift, but given "in consideration" as part of the contract for marriage. If the marriage was never entered into (regardless of which party broke the engagement) the contract is void and the ring should be returned.

When can you receive and eternity ring and can you purchase an eternity ring as a promise ring?

Usually eternity rings are given later in a marraige when you are sort of reaffirming that you would do it again. 25 years is sort of a normal time. I have heard people say that it is the ring they WOULD have given if they could have afforded it when they were young. However, I think, if you can afford it, promising eternity is a cool thing. Sure ups the expectation of what the wedding ring will look like though. :o) Just remember that when you give a promise ring, engagement ring, wedding ring, it is considered a gift and doesnt' have to be returned if you break up.

Can an ex or boyfriend request a gift back if it was given on a specific occasion?

Once a gift is given to another then the gift giver should not request the gift back unless it is a family locket or ring, etc. Once an ex or boy friend gives you a gift it is yours to keep.

Can gifts given to a romantic partner be forced to be returned?

No, protocol is when you give a gift to someone it's yours. If it's an antique ring or something that is handed down in the partner's family it would be out of the goodness of one's heart to give that item back and should be.

An engagement ring is considered a 'conditional gift' in the United States of America. Once the engagement has been broken, the ring has to be returned to the donor.

Do you get your engagement ring back if there is no longer an engagement?

It really depends on the circumstances behind the engagement, if the item is given during a holiday or as birthday gift then it might be assumed that it was a gift. However, if the engagement ring is not given as a gift the ring should be returned. The purpose of an engagement ring is to prove a man's commitment to a woman, if the engagement is broken off then the ring should most definitely be returned.

Get grandmothers wedding ring back from ex?

* Generally when an engagement ring or wedding ring is given then it is the woman's to keep, but if she was any kind of a woman knowing this was your grandmother's ring she should give it back. If need be offer to buy her a new ring in place of your grandmother's ring and of course it wouldn't be an engagement ring.

Who gets the engagement ring if you divorce?

The ring is the property of the wife unless there was some written agreement that it would be returned in case of a divorce. It was given in contemplation of marriage and the marriage took place.

Does engagement ring belong to the wife?

States' decisions on returning engagement rings can be grouped into four types. The first group of states considers the ring a conditional gift. A conditional gift is one that does not become final until a condition is met. That condition is usually the wedding. Fault may be considered under this rule, so that a man who calls off an engagement may not get the ring back unless the woman has misbehaved or been unfaithful. Other states have a no-fault rule and will not consider fault at all. The third type of state applies the implied gift rule, which means that the man cannot get the ring back if he breaks up the engagement, but a woman who breaks an engagement must return the ring. The last type of state applies the unconditional gift rule, which holds that an engagement ring is a like every other gift and the gift is final at the moment the ring is given. In states applying the conditional gift rule, the ring usually must be returned unless the man has misbehaved or did not have a legal right to make the gift conditional. For example, if he was still married to someone else at the time of the engagement he may not have had the right to make a conditional arrangement. In no-fault states the ring must always be returned. In implied gift states it depends on who breaks the engagement. In unconditional gift states the woman gets to keep the ring.Courts sometimes make exceptions to the usual rules on returning engagement rings if the ring is a family heirloom. The man is more likely to get a ring back if it is an heirloom. Other engagement gifts, including gift given by the woman to the man, are usually treated the same as engagement rings under state law.The best way to avoid any conflict about the return of the engagement ring in case of a breakup is to enter into a written agreement at the time of the engagement, stating what will happen to the ring. You may want to do this if the ring is a valued family heirloom. The issue of the engagement ring can also be included in an agreement called a prenuptial agreement.
