Yes, the state law applies. It is really the other way around. There can only be county or city laws if they don't contradict what the state laws say. Federal law supercedes state, state supercedes county and county supercedes city.

Not normally. City Ordinances must be subject to State Laws. E.g. when I read the NC State Constitution it basically reserves all rights to the state. Interestingly, the rule of "pre-emption" is whomever makes the law first wins. E.g. Federal govt makes laws outside of its Constitutionally granted rights but courts rule it preempts any laws made later by State. So, legislate away... the greedy strategy is to make as many laws/statutes (state)/regulations (agencies)/ordinances (cities)/etc as your group can; so, you will preempt any ideas another group my have.
