This question is answered differently by each person. However in this citizen's humble opinion, the answer is no. A non-citizen is not under or bound by the Constitution of the United States, and thus should not receive the rights thereof, insofar as those rights are not basic liberties such as freedom of religion, freedom of speech, etc.
Yes, according to the 14th Amendment, ALL persons have rights in the Constitution. Some of those Rights are explicitly provided to US Citizens but only where specified.
The right to vote for example.
But as the 14th states, and how the SCOTUS has upheld:
Nor shall any state deprive ANY PERSON of life, liberty or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the law.
The Constitution is very clear is differentiating between CITIZEN and PERSON.

To a certain extent! For other than minor misdemeanors fines and jail time should be levied as in the case of a citizen. However fraud, Extortion, embezzlement, anything to do with finance, or money, the non-citizen should be made to work and pay to the victim(s) back with interest. If this were the case once the victim(s) have been repaid, then the non-citizen should be deported! In the case of capitol offenses, where a death sentence might be the punishment, then the non citizen should be held in jail without bond, and their passport surrendered to the court. Too many time the court tries to treat these non-citizens as they would a upstanding member of their community. Their only avenue is to take flight back home. Many times the US doesn't have an extradition treaty! Therefore non-citizens get away with murder!
Not specifically, but legal immigrants are assumed to have the same rights as citizens, except for the restrictions attached to their immigrant status.

Illegals/Noncitizens are subject to the laws of their own Country, granted they must obey our laws but if arrested, their Embassy is contacted for their Countries intercession- Why b/c they are Subjects of their Country- Always- 1st & Foremost! Our Govt has eroded Citizens Rights by stating Everyone is Constitutionally protected! When the Constitution was written, many Noncitizens lived among Citizens and were NOT given the Rights that were granted to Citizens! You ERODE our Constitution when you freely give those Rights that many have fought & died for to anyone that steps foot on our soil!
