By convention, it is expected that the prime minister has a seat in the House of Commons (as the prime minister and ministers, both collectively and individually, are responsible to the House of Commons and must keep the support of that House to govern). Previously, it was also acceptable for the prime minister to be a senator, but this practice has fallen into disuse (the only senators to have been prime minister were the Honourable Sir John Abbott, the 3rd prime minister, and the Honourable Sir Mackenzie Bowell, the 5th prime minister).

Note that the prime minister does not hold a seat in either House by virtue of being prime minister; rather, he or she must be elected to the House of Commons in addition to being appointed prime minister by the Governor General for the Queen.

Yes. As a general rule, the Prime Minister has to have a seat in the legislative branch. If the legislative branch has two chambers, the Prime Minister will nearly always come from the lower chamber. Usually, the Prime Minister will be the leader of their party within the chamber.

If members of the chamber represent districts, then the Prime Minister will have to represent a district of his own. Some Prime Ministers such as John Howard of Australia and Arthur Balfour of the UK have lost their seats in a general election.

This is usually a convention and not a rule. Some countries like France sometimes have a Prime Minister who is not a member of the legislative assembly.
