In criminal law, a person is 'entrapped' when he is induced or persuaded by law enforcement officers (or their agents) to commit a crime that he had no previous intent to commit. There is no entrapment where a person is ready and willing to break the law and all the government agents do is merely provide what appears to be a favorable opportunity for the person to commit the crime. Entrpament occurs only when the criminal conduct was the of the agent?

Entrapment occurs when an officer entices a person to commit a crime, especially when the affected person had no intent to commit such crime. Entrapment can only be committed by an officer, not a civilian.

What occurs when a government agent deceives a defendant into committing a crimes?

The term for being coerced into committing a crime is "entrapment".The law enforcement officer doesn't necessarily need to deceive anyone for entrapment to occur. Any crime that results from an officer's initiative is considered entrapment.Entrapment can be considered a legal defense. If the defense can convince the judge or jury that entrapment has occurred, the defendant will be acquitted of any charges.

Who must be involved in an alleged crime for the defense of entrapment to be used successfully?

Entrapment is an affirmative defense to most criminal charges stemming from a law enforcement officer or agent of a law enforcement agency inducing the alleged defendant into committing a crime that he would not otherwise commit. The person who lures into person into the crime must be involved for the crime to commit.Another View: (In US criminal law) A person is 'entrapped' when they are induced (i.e.: "egged on") or persuaded by law enforcement officers or their agents to commit a crime that they had no previous intent to commit. However, there is no entrapment when that person is ready and willing to break the law and the government agents merely provide what appears to be an opportunity for them to commit it.

If some one uses your phone to make a drug deal to an agent and you don't know then the agent call you back and ask you to sale them drugs is that entrapment?

No. If the dealer used your phone without (supposedly) your knowledge and subsequently the agent called the number back again all he was doing was attempting to "prove" the reliability of his contact by making another purchase. The fact that he got ahold of you is totally indcdental. BTW: "Entrapment" is when someone urges or convinces you to do something that you wouldn't ordinarily do - an you actually do it.
