The only time you can ever tribute something you do not control, is if a card specifically says so.
Lava Golem lets you tribute the opponent's monsters, and Soul Exchange can let you do so too.
However if there is no text like this, then the tribute must come from amongst monsters you control.

The effect of "Kinetic Soldier" activates during the Damage Step when attacking a Warrior-type monster. In otherwords, right before you determine if a monster is destroyed and who loses Life Points, "Kinetic Soldier" will gain 2000 ATK. If its ATK is greater at this point, the opponent's monster will be destroyed. But if "Kinetic Soldier"'s ATK is still lower than the opponent's defending monster, "Kinetic Soldier" will be destroyed.

Yes, this is legal. You have two main phases, one either side of the battle phase, there is no rule that says a monster that attacks can't be tributed, or that attacking stops you summoning. You can attack with a monster, then tribute it for a tribute summon in main phase 2.
