Sounds like an out-of-adjustment, or failed brake light switch. Look under the dash and follow the brake pedal up to where it is attached at the top. Somewhere towards the top you will see a plunger switch that rests against the brake pedal arm. This is the switch that controls the brake lights. If it is out of adjustment it will give a constant signal as if the brakes were being applied. Try adjusting it to see if that solves the problem. If not, it will need replacing.
