Louis Charles said that his mother had abused him because he actually believed that she and his aunt had actually abused him. The revolutionaries brainwashed him into believing them so even when confronted with his sister and aunt he protested that he had actually been abused by his mother.
In most cases, the mother’s sister does not have automatic rights to the child of her deceased sister. In the event of the child being orphaned, the child's guardianship would typically be determined based on legal procedures, such as the deceased parent's will or court decisions. The aunt may be considered for guardianship or custody, but it is not guaranteed.
That depends on the legal custody agreement in place. If no custody agreement has been hammered out in court, you should contact the family court in your county of residence, or an attorney, for information on filing papers to assign temporary guardianship of your child to your sister. You may both have to appear in court so the judge can determine whether or not such an arrangement is in the best interests of the child. In other words, cover your bases. Fathers do have rights and if he finds out that you are violating his rights, you may be facing a custody battle.

It is unclear why you didn't obtain custody when your daughter was sexually abused. THat must have been quite some time ago if there was a trial and the defendant is now in jail. You must visit the family court immediately and ask to speak with an advocate. If possible you should obtain legal counsel; an attorney who specializes in custody issues. The attorney can review your situation, help you collect the necessary evidence and file for temporary custody pending a petition for sole custody. It is unclear why you didn't obtain custody when your daughter was sexually abused. I don't know about California per se, but generally custody goes to the mother, especially if paternity has not been established, until/unless changed by the courts.
