Officers do not need to see the actual crime in order to make a charge. Just as officers rarely witness the murder cases in which they make arrests, they need not witness traffic offenses if there is sufficient other evidence to support the charge.
In the case where a passenger in a vehicle pulled the brake and caused and accident, a charge of careless driving is probably warranted, because the passenger's testimony that he/she operated the brake suggests that the driver was operating the vehicle in such a manner to allow the passenger to have partial control over the vehicle.

I recently received a careless driving ticket for pulling into a gas station at less than 10 miles per hour.My brother had gotten into an accident in front of a gas station. When I arrived at the scene the police officers were present. Since 1 of the officers was in the middle of the 2 lane road directing traffic I slowed down. The speed limit was 45 on this road. Where my brothers car was gave enough room for a car to pass through to enter the gas station. When I pulled in between my brothers car and the patch of grass there were 2 people standing in the grass and another officer standing in the front of my brothers car, opposite to me. I was in no way endangering anyone at the scene; however, when I passed and pulled into a parking spot the officer that was standing near my brothers car stated "I want that bitch, who is that bitch,someone here better know her" . How is this right?
