With the new document requirements for crossing the border a "legal" entry can be made as a visitor with the proper documentation. Canadians will need a passport or enhanced ID and Mexicans will need a pssport and I-94. There are more detailed requirments for Mexicans such as residency requirments, proof of employment in Mexico, etc. All of the things that proves you intend on returning and not staying in the US.
