Are expandable batons illegal in NY?

Under Education law, s. 6435 and Penal Law, s. 265.20, NY Code (effective after the 2013 legislative session), it is illegal to carry any baton [billy] "which is twenty-four to twenty-six inches in length and no more than one and one-quarter inches in thickness" unless you are a private college security officer, certain auxiliary police, or are:

"1. . . . employed in fulfilling contracts with New York state, its agencies or political subdivisions for the purchase of billies or blackjacks; or

2. . . . employed in fulfilling contracts with sister states, their agencies or political subdivisions for the purchase of billies or blackjacks; or

3. . . . employed in fulfilling contracts with foreign countries, their agencies or political subdivisions for the purchase of billies or blackjacks as permitted under federal law."

Carrying a baton is criminal possession of a weapon in the 4th degree, a Class A misdemeanor.

If your parents consent, the state has no problem with someone moving out a few months early. This is not considered negligence on the part of your parents nor can you be held as a runaway.

The tricky part is securing housing for yourself. You will either need to move in with someone who accepts payments regardless of your legal inability to sign a contract, someone who will allow you to stay free or your parents will need to sign your lease for you. This means that they are responsible if you do not pay your rent.

But, the High Court recently ruled persons have no guarantee of privacy when it pertains to phone conversations It had something to do with a wire tape in a drug investigation. Maybe it depends on who is doing the recording and why.
  • No. Md. Code Ann., Courts and Judicial Proceedings � 10-402: It is a felony to intercept a wire, oral or electronic communication unless all parties to the communication have consented. But all-party consent will not make the recording legal if there is a criminal or tortious purpose behind it. Disclosing the contents of intercepted communications with reason to know they were obtained unlawfully is a crime as well. Violations of the law are felonies punishable by imprisonment for not more than five years and a fine of not more than $10,000. Civil liability for violations can include the greater of actual damages, $100 a day for each day of violation or $1,000, along with punitive damages, attorney fees and litigation costs. To recover civil damages, however, a plaintiff must prove that the defendant knew it was illegal to tape the communication without consent from all participants. Md. If the recording of a phone conversation is legal in the state in which the call is received then it is irrelevant where the phone call is originating from. Regardless of existing state statutes laws prohibiting the taping of phone conversations are seldom enforceable when they pertain to private issues such as debt collections. Appellate courts in all states have ruled that there can be no reasonable expectations of the caller that any phone conversation is confidential.

It's not so much a list as it is an index or table of contents. The city outsources the service to a company that does the same thing for many other governing bodies. There is sometimes a delay in getting new items "codified" and posted. Along with the Code of Ordinances, you will find the City Charter, another interesting read, considering how business is done in defiance of this local body of law. Here's the link.
