Trademarks can exist from mere use in commerce, in some jurisdictions. You check the industry publications to see if the words or logo are "used in association with goods or services" in the form of a trademark.

You can also search state and federal databases to find which trademarks (or service marks) have been registered. The US Patent and Trademark Office has one at uspto.gov, and many states' offices of the secretary of state have online access as well. Similarly, some other countries (Canada) have online searchable databases, as does the European Union (for a "community" mark).

Or you can hire a search firm to run a search and produce a report.

Obviously, if you are checking a trademark that you intend to use on your own products, the cost of a professional opinion from a trademark attorney may be cheap insurance against having to start over with a new brand if you miss something in your search.

What are the steps to sue someone for trademark infringement?

To sue someone for trademark infringement, you must first obtain proof that a person was using your trademark or purposes not related to the government, such as schooling, or governmental advertising purposes. Also, you must have fair proof that the person was using it knowing that it was trademarked and/or of your design. You should also check no changes have been made to the trademark, as even small changes are considered changing the trademark to look differently. You then go to court, fill out all forms, and go to court on the day given to you by administration.
