Can I have a restraining order against your wife when she has one on me?

If she is doing something that gives legal cause for one, maybe. But it would be difficult to prove that she is threatening you and that you are not violating your restraining order.

In Texas can a husband file for divorce and obtain a restraining order to kick out the wife and children?

As for the restraining order, it would probably depend on why you felt you needed the restraining order against her. Has she harmed or threatened to harm you? Or do you just want to be single again? As for the children, I can't see any judge giving you a restraining order against them, and may even let the wife take out a restraining order on you for trying to kick her and your innocent children out on the street. That could be considered child abuse, child endangerment or at the very least, neglect. As for filing for divorce, anyone can do that at any time. And keep in mind, you will have to pay child support whether you choose to visit your kids or not. Although, if they are your stepchildren, then you shouldn't have to pay child support on them but, depending on the laws in Texas, you may have to pay spousal support (alimony).

How do i get a restraining order against my ex wife if she is threatening to take my son out of the country?

You will have to get in contact with your lawyer who will then file a case against your wife, and so prevent her from taking your son out of the country.

Husband is filing divorce wife has restraining order against him protecting wife and kids how can we reconcile marriage?

Husband will have to petition the judge who issued the restraining order against him to modify it to allow face-to-face contact in the presence of a marriage mediator. However, if the other party is adamant and does not wish mediation, it appears futile to petition the judge to order it, however you can always try. The judge who issued the restraining order will have to become involved since it is only he, who can modify it.

Can visitation stop with the father if his new wife the step mother was arrested for assault and battery against the father?

Not necessarily. Unless there is a restraining order in place barring the father from the children, he still has parental rights. If there is an order barring the step mother from the children, then the father still has visitation, but he cannot have them around his wife, nor can he speak about her to the children, or even so much as sign her name on a birthday card for the children.

Is it a crime if a wife and her friend attempt to set her husband up for following her to a hotel thinking that he will break in on her and it failed.?

If a wife and her boyfriend set her husband up to follow her to a hotel, they could get in trouble. If the wife has a restraining order against the husband, this could cause her to get in trouble. Not to mention it is entrapment.

What would it be called when an ex keeps me from seeing my 16 yr old son we have 50 50 custody but he has a restraining order against me to keep me away which is causing mental issues for my son?

If the ex-boyfriend/girlfriend or ex-husband/wife has a custody order that you have agreed on legally, but has a restraining order against YOU, that does NOT apply to the child, and you have rights that are being trampled on. Assuming you have a lawyer, then a mediator should be used, perhaps a neutral relative, to meet you so you don't violate the restraining order. This issue of the custody should have been addressed when the restraining order was issued! Call the lawyer and ask advice on what to do, or call the court directly and inquire . If the restraining order INCLUDES your 16 year old child, then you must fight the restraining order, which IS your right to do. There should be a date when the restraining order will expire and therefore, a court date to extend it if the person who got it wants to extend it. That is your chance to show up and give cause as to why it SHOULD NOT be extended and also bring up the issue of shared custody.
