You have to use your own editor like the place you upload your pictures on. I have a Kodak Camera, so my pictures are edited in Kodak EasyShare.
For some pictures yes, and for others no. It is illegal to use copyrighted images for your own purposes. It is also illegal to search for, store, and view certain images like child pornography. If the image is in the public domain and is not obscene, then you can use the pictures.
If you search for "War pictures" on Google, you will be able to find numerous war pictures. You can also adjust settings, and change the resolution (and thereby changing the quality of the picture) and many other things. You can specify your own screensize, if you wish to use the pictures as a wallpaper.
If the worker is willing to give you the pictures he has taken, you can use them for your purpose as well. There is no reason to make a legal issue out of it. You would have a weak case.

Windows provides a folder called "My Pictures'. But you can create and use any folder you wish. Some applications will create their own image file folder, some will use My Pictures, and all will let you determine where to put their images.
Not really enough info was given (e.g.- the questioner never states that any threat to use the disc was given) - but it does sound as if the disc of pictures is being used as leverage for some reason.
